This User Agreement and Privacy Policy, and all other policies posted on the Hire.Bid website set out the terms by which Hire.Bid, a division of HireBid LLC, offers you access to and use of the Hire.Bid marketplace and related services.
Hire.Bid is a marketplace that allows service providers (sometimes referred to as professionals) to connect with service buyers (sometimes referred to as clients or consumers). Hire.Bid has no control over the contents of service provider profiles, time blocks, projects, or any of the other content generated by third parties (including service providers and service buyers) on our website. As such, Hire.Bid does not guarantee the accuracy or reliability of the information on the website. In addition, Hire.Bid has no control over and assumes no liability for the actions of individuals who are connected to one another through the Hire.Bid website. For example, Hire.Bid has no control over and assumes no liability for the performance of services by service providers on projects or the actions or inactions of service buyers on projects. Users of the website should do their own due diligence prior to bidding on a service provider's time block, accepting a bid/project, or hiring a service provider for a project. In addition, Hire.Bid does not guarantee the reliability of aggregated data (such as average ratings) as a predictor of the level of service rendered on a particular project.
Any agreement between a service provider and a service buyer for services to be rendered on a project is a contract or agreement between the service provider and the service buyer, and Hire.Bid is not a party to such contract or agreement.
Hire.Bid charges a 6.9% commission for use of the marketplace from the gross payment from the service buyer. In addition, any fees charged by our payment processor, Stripe, will be deducted from the gross payment (as of early 2017, Stripe charges a fee of 2.9% + $0.30 per transaction). Upon payment by the service buyer, the service provider is paid the net amount for the time block, after deduction of Hire.Bid's fee and the payment processing fee. This payment will occur in most cases prior to the performance of the agreed-upon services. Nevertheless, once a bid has been accepted, the parties to the agreement (service buyer and service provider) have a legally binding contract to fulfill the obligations under that agreement. Hire.Bid does not directly process payments or have access to confidential payment information, such as credit card, debit card, and bank account information. These are directly processed via a secure connection by Stripe, using Payment Card Industry Data Security Standards (PCI DSS).
You agree to the following:
That all information that you post (including information on your service provider profile, time blocks, and/or project information) is true and accurate.
That you will use the website solely for its intended purpose, facilitating the connection of service providers and service buyers.
Not to post or upload inappropriate content or items, such as, for example, items containing irrelevant, profane, offensive, or vulgar language or content.
Not to use the Hire.Bid website to engage in illegal activities.
Not to post false, misleading, inaccurate, defamatory, or libelous content.
As a service buyer, to provide accurate ratings of as to your opinion of service provider performance.
Not to use the Hire.Bid website to post spam, unsolicited communications, distribute viruses, or take any other actions to harm Hire.Bid or our users.
Not to violate Hire.Bid's intellectual property rights, including our patent rights, and our rights in our copyrights and trademarks, and not to violate any other third party's intellectual property rights.
That, by placing a bid on a time block, you have entered an offer for a time block that, if accepted, will result in a binding agreement to pay the agreed-upon price.
That, by accepting a bid for your time on the Hire.Bid website, you have entered into a binding agreement to provide the services as specified in the bid that was accepted at the time of the time block.
As a service provider, you consent to having a service buyer rate your performance on a time block procured through the marketplace.
To permit Hire.Bid to use your profile data in promotional materials.
That, by using the Hire.Bid website, including posting or editing your service provider profile, your time blocks for bidding, or a project, you grant Hire.Bid the right to request additional information from you and/or contact third parties, in order to verify the accuracy and truthfulness of any and all information you have posted on the Hire.Bid website.
That, by posting or editing information on your service provider profile, your time blocks for bidding, or projects, you agree to provide Hire.Bid a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable right in all such content. All other content posted on the website (including ratings data) is the exclusive property of Hire.Bid.
Hire.Bid reserves the right to take any lawful action to correct a violation of the User Agreement, including, but not limited to, terminating the account(s) of a user who violates the User Agreement and/or removing or revising content (such as service provider profiles, time blocks, profile pictures, or project information), in whole or in part, that violates the User Agreement or for which the veracity of the content posted cannot easily and readily be verified.
More generally, Hire.Bid reserves the right to remove any content, including content with respect to projects or user profiles, and to bar individuals from using the Hire.Bid website, for any reason that Hire.Bid, in its sole discretion, deems is improper or otherwise inconsistent with the functions of the Hire.Bid website or detrimental to other users.
In addition, Hire.Bid reserves the right to delete and/or remove from certain areas, such as the Featured Professionals listings, notwithstanding the fact that such listings have been paid for, any profiles or other content that is inconsistent with the purpose of this website, misleading, or inappropriate or offensive, and any fees paid will not be refunded.
We cannot guarantee the continuous operation of our website, or that all website functions are operating properly at any given time. As such, you agree that you are using the Hire.Bid website at your own risk. We disclaim all express or implied warranties, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.
We are not liable for any damages or losses resulting from your use of our services or from the actions or inactions of third parties who you were connected with through the Hire.Bid website (including service providers and service buyers that you were connected with on a project through Hire.Bid).
By using the Hire.Bid website and related services, you expressly consent to our use, collection, disclosure, and retention of any and all personal information that you disclose on the website or that is collected via our servers as a result of your visiting the website, as well as any and all information provided by third parties on the website as to you (such as, for example, ratings data).
Our primary purpose in collecting data from users of the Hire.Bid website is to provide our users with access to our website, in order to facilitate the connections of service providers with service buyers on projects.
We do not sell any data, including the non-publicly accessible data we collect from our users, to third parties.
The Hire.Bid website is not intended for children under the age of 13. We do not knowingly collect information from users in this age group.
We may amend this User Agreement and Privacy Policy at any time.
